PRELIMINARY ARTICLE: DEFINITIONS

Each of the terms mentioned below will have in these General Terms and Conditions of Sale Law Profiler (hereinafter referred to as the "GTC") the following meaning:
Job offer: refers to all elements and data (visual, textual, photography, recruitment conditions),deposited by a Recruiter under his exclusive editorial responsibility,  in order to recruit a Candidate for an internship, a work-study program or a job and disseminated on the Website and the Web application.
Candidate: refers to a natural person looking for an internship, a work-study program or a job, who has created a Personal Account from the Site.
Personnel Account:  refers to the free space that any User must create and to which he must connect from the Website or the Web application, in order to access all the Services offered by Law Profiler, subscribe to one or more paid option(s) and purchase credits.
MEDIA PLUS: refers to the company that publishes and operates the Website, MEDIA PLUS, Société Anonyme Monégasque (SAM) with a capital of €160,000, whose registered office is located at 1, Avenue Henry Dunant, Palais de la Scala - 98,000 Monaco, registered with the Monaco Trade and Industry Register (RCI) under number 69S01228.
User: means any visitor, having access to the Law Profiler Services, via the website or web application.
Recruiter: refers to a natural or legal person, acting in a professional capacity, representing a structure looking for candidates for an internship, a work-study program or a job and having created a Personal Account from the Site.
Services: refers to all Law Profiler services made available to Recruiters and Candidates on the Website.
Website: refers to the Website operated by MEDIA PLUS accessible from the URL  www.lawprofiler.com  and allowing Users to access the Law Profiler Services via the Internet.

ARTICLE 1: PURPOSE OF THE GENERAL CONDITIONS OF SALE

The purpose of these GTC is to define the reciprocal rights and obligations between Law Profiler, published by the Company Media Plus and the Users of the site in the different stages of the order of one or more services offered by Law Profiler. No purchase can be made without first accepting the GTC.

These GTC are applicable to any online purchase of services concluded between Law Profiler and Users having the status  of  professionals or consumers.
According to Article 2 of Law No. 1.482 of 17 December 2019 pour une Principauté numérique,the consumer is defined as "the natural person who acts for purposes that do not fall within the scope of his commercial, industrial, artisanal, liberal or agricultural activity" and the non-professional as "any legal person who does not act for professional purposes".
Any User declares to have the legal capacity allowing him to place an order on the Site and to use a credit card.

We invite you to read these Terms carefully before placing an order on Law Profiler. By ordering a service on Law Profiler, you notify your agreement to be subject to these GTC.

ARTICLE 2:  MODIFICATION OF THE GENERAL CONDITIONS OF SALE

Law Profiler reserves the right to update and amend the GTC at any time. The GTC applicable to the sale of a service are those in force at the time of the conclusion of the sales contract.

ARTICLE 3:  AVAILABILITY AND ENFORCEABILITY OF THE GENERAL CONDITIONS OF SALE

The GTC are made available to the User on the Site where they can be directly consulted.
The User must, before each order, adhere to the GTC by ticking a box provided for this purpose and indicating that theUser has read and accepted the GTC.

These GTC including the order confirmation email and the invoice, form a contractual whole and constitute the entire contractual relationship between Law Profiler and the User.

ARTICLE 4:  NO WAIVER

The fact that Law Profiler refrains from requiring at a given time the execution of one of the stipulations of these GTC cannot be interpreted as a waiver to invoke later said total or partial non-performance.

ARTICLE 5:  VALIDITY OF THE GENERAL CONDITIONS OF SALE

If any of the provisions of these GTC is declared null and void or is, in whole or in part, unenforceable, the other stipulations, rights and obligations arising from the GTC will remain unchanged and will remain applicable if their application is not made impossible.

ARTICLE 6:  DESCRIPTION OF PAID OPTIONS

The User connected to his personal account, candidate or recruiter, has the possibility to subscribe to paid options by credit card from the Website and the Web application.
Payment is due from the subscription of each paid option.

 

Access to the Law Profiler Services (CV creation, consultation of job offers, application, news, etc.) is free of charge.
Only the Boost option on the front page is paying.

ARTICLE 7:  PRICES

Prices are expressed on the site in euros all taxes included for Candidates.
Prices are expressed on the site in euros excluding taxes included for Recruiters.
Law Profiler reserves the right to change, at any time, the prices of the Services. The Services will be invoiced on the basis of the rates in force at the time of registration of the orders.
Promotion codes are valid on the conditions and dates indicated. A code can only be used for one order.

ARTICLE 8:  ORDER

Any order placed on the www.lawprofiler.com site constitutes the formation of a distance contract between Law Profiler and the User.
The User must have created an account on the Site and connect to it to be able to order one or more services.

The User has the possibility to check the details of his order and its total price and to correct any errors before confirming his acceptance. It is therefore up to the User to verify the accuracy of the order.
The sale will only be considered valid after full payment of the price.
A summary of the order will be sent by email to the User.
Law Profiler also reserves the right not to follow up on an order due to a manifest breach of the GTC or in the event of fraudulent acts.

ARTICLE 9:  INVOICE

Any subscription of paid option by credit card will give rise to an invoice.
Users can directly download the invoices for their purchases. To do this, they must connect to their personal space and go to the "My orders" tab.
Candidate: in the dashboard, click on option, tab "My orders".
Recruiter: in the dashboard, click on credits, tab "My orders".

ARTICLE 10: MODIFICATION OF THE ORDER

Any modification of the order by the User, after confirmation thereof, is subject to acceptance by Law Profiler.

ARTICLE 11:  RIGHT OF WITHDRAWAL

According to Article 10 of Law n° 1.383 of 2 August 2011 sur l’économie numérique, the User has a period of seven (7) clear days to withdraw. For Users located in the European Union and according to the regulations in force in the European Union, they have a period of fourteen (14) calendar days to withdraw.
However, by validating the order, the User acknowledges and  accepts  that Law Profiler begins to perform the service  immediately. Consequently, the User  expressly waives his right of withdrawal related to online or distance selling. No request for withdrawal, cancellation or refund will be admissible.

ARTICLE 12:  REFUND

Credits are non-refundable.
Paid options are non-refundable.

In case of deletion of a Personal Account

For Recruiters, the deletion of a Personal Account entails the deletion of any attached Advertisement(s), and consequently, the deletion of any paid option(s) subscribed for these Ads and does not give right to any right to reimbursement or compensation, which the Recruiter acknowledges and accepts.
For Candidate(s), the deletion of a Personal Account entails the deletion of any paid option(s) subscribed for the highlighting of the CV and does not give right to any right to reimbursement or compensation, which the Candidate acknowledges and accepts.

The deletion of a Personal Account entails the deletion of the associated credits, not giving right to any right to refund, which the User acknowledges and accepts.

In case of deletion of the Ad

In the event that Law Profiler is forced to delete the Ad or CV with option highlighted during distribution due to its non-compliance with the distribution rules specified in the General Terms and Conditions of Use and in particular because its content has been, legitimately reported as abusive, Law Profiler will not reimburse the Recruiter or the Candidate the credits and / or the amount of the paid option (s) subscribed (s) during the deposit or modification of the Advertisement or CV thus deleted during distribution.

ARTICLE 13:  LIABILITY, FORCE MAJEURE
Law Profiler cannot be held liable in the event of non-performance or improper execution of the order due, either because of the Recruiter or the Candidate, or a case of force majeure.

ARTICLE 14:  PERSONAL DATA

Law Profiler attaches particular importance to the protection of your personal data and undertakes to comply with the laws in force.
Law Profiler undertakes to make use of personal data strictly limited to the following purposes:
 - connect recruiters and candidates;
-allow candidates to access and apply for job offers posted on the site;
-make CV accessible to recruiters, according to the chosen confidentiality settings;
- manage the processing of applications for recruiters;
- present the search results and recommend relevant jobs to candidates;
-facilitate communication in the context of job search;
-contact candidates and recruiters in the context of updating the site, carrying out surveys, communicating general information or related to the service.

ARTICLE 15:  LANGUAGE

These Terms are written in French. In the event that they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.

ARTICLE 16:  APPLICABLE LAW AND JURISDICTION

Any dispute that may arise between Users and Law Profiler, concerning the formation, execution or interpretation of these Conditions will be subject to Monegasque law and will be the exclusive jurisdiction of the Monegasque courts
In the event of any dispute arising out of or related to these Terms, Users and Law Profiler agree to seek to resolve the dispute through negotiation or other appropriate dispute resolution process prior to resorting to legal action.
The consumer has the possibility to resort, in the event of a dispute, to a conventional mediation procedure or to any other alternative method of dispute resolution. Pursuant to Article 14 paragraph 1 of European Regulation No 524/2013 of 21 May 2013 on CLR, the European Commission provides consumers with an online dispute resolution platform available at this address:  https://ec.europa.eu/odr
